Welcome to BoosterFlow. These Terms of Service ("Terms") govern your access to and use of BoosterFlow's services, software, and websites (collectively, the "Service"). 1. Acceptance of Terms

By creating an account, accessing, or using BoosterFlow, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

3. User Accounts

4. Payment Terms and Billing

BoosterFlow operates on a subscription basis with a 14-day free trial. Detailed payment, billing, cancellation, and refund policies are available in our Payment Policy, which is incorporated into these Terms by reference.

By providing payment information, you authorize us to charge your payment method for all fees incurred under your account. You are responsible for maintaining valid payment information and for all charges incurred under your account.

All fees are non-refundable except as expressly stated in our Payment Policy or as required by law.

5. Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Attempt to gain unauthorized access to any portion of the Service or any other systems or networks

By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, process, adapt, and display your User Content solely for the purpose of providing the Service to you.

BOOSTERFLOW DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE SERVICE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BOOSTERFLOW, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID TO BOOSTERFLOW IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

11. Indemnification

You agree to defend, indemnify, and hold harmless BoosterFlow and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.

12. Termination

By You: You may cancel your subscription at any time by contacting us or using the account cancellation features within the Service. Upon cancellation, you will retain access to the Service through the end of your current billing period as described in our Payment Policy. After your billing period ends, your access to the Service will cease.

By Us: We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, with or without notice, for any reason including but not limited to:

• Violation of these Terms
• Fraudulent, harassing, or abusive behavior
• Failed payment (subject to the grace period outlined in our Payment Policy)
• Extended period of inactivity

Effect of Termination: Upon termination, all provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability. You may export your data prior to the end of your access period.

13. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes to these Terms, we will notify you by email or by posting a notice on our website prior to the effective date of the changes.

Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Maryland, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except that either party may seek injunctive relief in court. You agree to waive any right to a jury trial or to participate in a class action.

15. Export Compliance

You agree to comply with all applicable export and import control laws and regulations in your use of the Service. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent possible, and the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and Payment Policy, constitute the entire agreement between you and BoosterFlow regarding the Service and supersede all prior agreements and understandings, whether written or oral, regarding the subject matter herein.
